Sustainability-oriented integration of land-use policy “economic control instruments” into the spatial planning and financial system of the state of Baden-Württemberg

The project investigated the extent to which a system of land designation certificates (FAZ) or a building land designation levy (BLAU) could be incorporated into the spatial planning and financial system of the state of Baden-Württemberg for sustainability policy reasons and what effects would result under these conditions for the Rhine-Neckar-Odenwald model region in Baden-Württemberg. With these so-called “economic control instruments”, the designation of new building areas by the municipalities is subject to a certificate or levy obligation.

During the course of the project, several workshops were held in which local authority representatives from the model region and representatives of regional and state planning were involved in the project work.

As part of the project, the IAW designed various instrumental design options for both the certification rate and the apportionment solution and assessed their land policy implications as well as the inter-municipal fiscal distribution effects. Simulation calculations were also carried out in this context.

The IAW's investigations have shown that, from an economic and economic science perspective, both area designation certificates and a building land designation levy could basically be considered for implementation at state or regional level, although efficiency deficits would be expected for the certificate approach in the case of a regional solution.

The IAW's legal cooperation partner, Professor Dr. Willy Spannowsky, stated that if the control instruments were implemented at state level, the legal hurdles would be higher for the zoning certificates than for the building land designation levy (BLAU).
